By using Flowza ("Service"), you agree to these Terms of Service ("Terms"). These Terms form a binding agreement between you ("User", "Business") and Flowza ("we", "us", "our"). We've written this to be as human-readable as possible. If anything is unclear, email us at [email protected].
1Acceptance of terms
By creating a Flowza account or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using Flowza on behalf of a company or organization, you confirm you have authority to bind that entity to these Terms.
If you do not agree with any part of these Terms, do not use the Service.
2Description of service
Flowza provides an AI-powered sales and communication automation platform that includes: AI-driven responses on WhatsApp, Facebook Messenger, and Instagram DM; Google and Facebook review reply automation; Facebook comment-to-inbox automation; and a unified conversation inbox.
What we do not guarantee:
- !AI accuracy: We make every effort to provide accurate, helpful AI responses, but AI-generated content may occasionally be incorrect, incomplete, or inappropriate. Business owners are responsible for reviewing AI outputs, especially for sensitive conversations.
- !Platform availability of Meta or Google: Flowza relies on Facebook, WhatsApp, Instagram, and Google's APIs. Platform-level outages or API changes by these providers are outside our control and do not constitute a breach of our service.
- !Message delivery: While Flowza processes and sends messages reliably, final delivery is subject to the respective platform's delivery infrastructure.
3Account responsibilities
When you create and use a Flowza account, you agree to:
- →Provide accurate, complete, and up-to-date registration information.
- →Maintain one account per business (unless you are on an Agency plan, which explicitly allows multiple sub-accounts).
- →Keep your login credentials secure and not share your account with unauthorized individuals.
- →Notify us immediately if you suspect unauthorized access to your account at [email protected].
- →Take responsibility for all activity that occurs under your account.
4Acceptable use
Flowza is a tool for legitimate business communication. You agree not to use the Service to:
- ✕Send spam, unsolicited bulk messages, or messages to users who have not opted in to receive communications from your business.
- ✕Generate or distribute illegal, misleading, fraudulent, or harmful content.
- ✕Create AI personas that deceive users into believing they are speaking with a human in a way that causes harm or violates platform policies.
- ✕Violate WhatsApp Business Policy, Meta Platform Terms, or Google API Terms of Service.
- ✕Resell, license, or white-label Flowza to third parties without prior written permission from Flowza.
- ✕Reverse engineer, decompile, or attempt to extract the source code of the Flowza platform.
Violations of acceptable use may result in immediate account suspension without refund.
5Subscription & billing
Flowza is a subscription service billed monthly or annually, in Bangladeshi Taka (BDT). Accepted payment methods include bKash, Nagad, credit/debit cards, and bank transfer.
- →Billing cycle: Subscriptions renew automatically at the end of each billing period (monthly or annual). You will be charged on the same date each period.
- →Refund policy: If you are charged for a new billing period and request a refund within 7 calendar days of that charge, we will issue a prorated refund for unused days. Requests after 7 days are not eligible for refunds.
- →Plan changes: Upgrades take effect immediately. Downgrades take effect at the start of your next billing cycle — you keep access to current features until then.
- →Failed payments: If a payment fails, we will retry for up to 7 days and notify you by email. After 7 days without resolution, your account may be suspended. Your data is not deleted — reactivation is possible by updating your payment method.
6AI-generated content disclaimer
Flowza uses large language models (including OpenAI GPT models) to generate automated responses to your customers. By using Flowza, you acknowledge and agree to the following:
- !AI replies are generated based on the knowledge base and instructions you provide. You are responsible for the accuracy and appropriateness of the information you train your AI on.
- !All AI-generated content sent on your behalf is your responsibility. Flowza provides the tool; you are the business publishing the responses.
- !We strongly recommend using "Approval Mode" for review replies and sensitive conversations until you are confident in AI output quality.
- !Flowza is not liable for any customer complaints, lost business, or damages arising from AI responses that are inaccurate, off-brand, or inappropriate.
7Termination
By you: You can cancel your Flowza subscription at any time from your billing settings. No questions asked, no cancellation fee.
By us: We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or abuse the platform in a way that harms other users or Flowza's infrastructure.
Data after cancellation: Your data is retained for 30 days after cancellation to allow for reactivation or data export. After 30 days, all data associated with your account is permanently deleted from our systems.
8Limitation of liability
To the maximum extent permitted by applicable law, Flowza's total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total fees paid by you to Flowza in the three (3) calendar months immediately preceding the event giving rise to the claim.
Flowza is not liable for indirect, incidental, consequential, or punitive damages, including but not limited to: lost profits, lost revenue, lost data, business interruption, or damage to reputation — even if Flowza has been advised of the possibility of such damages.
9Changes to these terms
We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. When we make material changes (changes that significantly affect your rights or obligations), we will:
- →Notify you by email at least 14 days before the changes take effect.
- →Show a prominent notice in your Flowza dashboard.
- →Update the "Last updated" date at the top of this page.
Continued use of Flowza after the effective date of changes constitutes acceptance of the updated Terms.
10Governing law
These Terms are governed by the laws of Bangladesh. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
For international customers: while we apply Bangladeshi law as the governing jurisdiction, we are committed to complying with relevant data protection laws including GDPR for EU users.
